How would an insurance provider prove you "knowingly" exceeded GVWR, unless you told on yourself.  I would assume that they'd just deny the claim for whatever reason and let the individual prove otherwise.

 Absolutely 100% false.  Also, if the incident is property damage only, there is no obligation to even take a collision report.
