Can someone post when the Ohio elections will be done. -------------- Please do post the dates...that will allow time to properly notify your Union Brothers and Sisters of the Union rep in Strongsville that is now representing their ' best' interests. If one should choose to protect within...make it equal for those who honor their membership, as well. They have the right to be informed...solidarity. For the record...this one will not go away. I believe in our legal system. I believe in justice. And I seek it. To quote Theodore Roosevelt: "Speak softly and carry a big stick; you will go far.''
  3. --------------- Just as a criminal has the right to a trial by a jury of his peers. Isn't the Membership his peers? Criminal records are public record. In a society governed by laws, we, as a community, have access to these records. What is the difference between the laws that govern our cities and states and the procedures that are conducted "in-house" at Ford? Why is one so protected?
  4. It is my understanding that the UAW is a labor union founded in order to represent workers in the automobile manufacturing industry. Unity is defined as "the state of being undivided or unbroken completeness or totality with nothing wanting." Solidarity is defined as "unity (as of a group or class) that produces or is based on community of interests, objectives, and standards". The word Community often "refers to a group that is organized around common values and social cohesion." Again...I'm trying to understand the true principle behind the Union at the Avon Lake Plant. These questions are directed locally. By no means to attack or discredit it...but more so to explore its weak link. Why is it acceptable to the Membership, as a whole, to reward a terminated employee that betrayed his "community" of brothers & sisters? Why can't the Membership, on which this whole principle of Unity is based, be privileged to the facts surrounding the alleged crime? (Again, facts; not grievance discussions) Why is it okay that the Union, that was put in place to protect the rights of the Members ,see fit to conceal the wrong doings of another member of their community? To protect one is not to "protect the interests, objectives and standards" of all. I do not imply that the Union Officials condoned the acts in which led to this employee's termination...yet they have put forth great efforts to conceal them. Why is that? We're not talking about confidentiality anymore. This has gone far beyond that. Many employees are discharged for different reasons and many of these reasons are common knowledge. No great shroud of secretcy has encompassed them. But...an elected Union official, BC to be exact, is terminated...and one of the greatest blankets of silence has fallen over this plant. Why? Why isn't the Membership outraged? Disgusted? In search of answers that they deserve as a Unified Entity? No secret that I have a vested interest in this situation...but on the flip side...I would be insulted and outraged as a Member that my Union would reward my elected official for betraying my "community" of brothers and sisters. Solidarity should protect the majority, the dedicated, the hard working...

No need to take my word, though, as his recent employer is listed on the Lorain Co. Court of Common Pleas PUBLIC court docket in the same entry that contains his Child Support arrears provided by CSEA. Just as I have a vested interest in this situation...I would think that the Membership would, as well...just for different reasons.
  7. It has already been established that personal grievances are a private matter and nothing will be shared with any party not involved. That is the way all of my personal grievances were handled. PRIAVETLY. If they were shared on a public forum or with a party not involved I WOULD SUE ALL PARTIES UNION, COMPANY AND THE @#$$% INVOLVED. So you will not see any private grievcance information OK. Now I would ask, What is your motive. ------------------ Although your above response was not directed at my post, I can respond that I do understand the specifics of what went on within the hearings is a private matter. Confidentiality is understood. My questions are not about the particulars of Fred's grievenace, but instead about the process and the procedural laws that are in place. Those cannot possibly be confidential as every structure has basic, common-knowledge rules and regulations in place. Those are the answers that I am looking for: 1. Is employee actually terminated before or after grievance procedure? 2. In the event a grievance is closed, can it be reopened? 3. Upon reopening, is this considered same tenure employment or new employment? 4. Can the company monetarily settle with a terminated employee? 5. Is it normal/ethical procedure that a terminated employee of Ford can retain employment through another UAW represented company and be able to hold another Rep position? 6. Can a terminated Ford employee that once held a Union position run for Chairman of another company represented by the SAME union? 7. WHAT IS THE PROCEDURE IF AN EMPLOYEE VOLUNTARILY WITHDRAWS THEIR GRIEVANCE? HOW CAN THEY REINSTATE IT? I am coming to the source for the information I seek; that being the Members. Currently, this is the only outlet I know of that may be able to guide me in the right direction. I'm not going to pretend I know something that I do not. That is why I am asking. My motives are very clear...I seek information...and I would like answers.

The check was NOT picked up by Fred on Thursday...it was given to his brother, who also works in the plant.
  9. Maybe you can shed some light on the grievance procedure for me. In an attempt to understand, I ask: An employee of Ford Motor is terminated. Employee files grievance. Is employee actually terminated before or after grievance procedure? In the event a grievance is closed, can it be reopened? Upon reopening, is this considered same tenure employment or new employment? Can the company monetarily settle with a terminated employee? Is it normal/ethical procedure that a terminated employee of Ford can retain employment through another UAW represented company and be able to hold another Rep position? Furthermore, I agree that I should be talking to an attorney. Unfortunately, I cannot afford one anymore; hence, my personal search for information.
  10. As I stated before...please educate me on your grievance procedure. I can only tell you what Ford has told CSEA and what has been told in Court. I am not implying anything regarding your company. I am repeating what was explained to me and CSEA. Fact is, the money is owed. Not up for argument as that figure has recently been updated on 2/12/2010 on Lorain Co. Court of Common Pleas PUBLIC court docket. The figure IS in excess of $61,000. So, the order WAS in place as of 2007. His employment DID cease. There WAS a grievance. He WAS paid. The check went directly to him. CSEA inquired as to why the garnishment was NOT honored. YOUR company explained he WAS terminated...which terminated the order. I'm not throwing out wild accusations but, instead, shedding some light on the question of whether he got the buy-out or not. He did. You wanted to know how I know. This is how I know. I am DIRECTLY involved. The unjust results of this entire situation has had a direct impact on my family. Please, your knowledge is wanted...not your hostility. I want answers...and I would think that the Membership would want answers, as well. Not in response to my situation, but to the 'special' circumstances that seem to be involved that directly affect the politics of your company.

To answer your eloquent question...They were repeating the information that was given to me as to why Ford Motor was able to pay Fred directly completely enabling him to avoid his Court Ordered Child Support/Alimony order that is over $61,000 in arrears. (That figure is public record via Court Docket). Granted, you are correct...I do not know the process. BUT...I do know that I have been in court for over three years attempting to collect my and my children's money. I do know that Ford confirmed the buyout. I do know that Ford confirmed the check was picked up BY FRED on Thursday. I do know that, when Ford was questioned as to why the garnishment was not honored...they explained that he was terminated, which terminated the order. Fact is: He was terminated. He was paid a very large lump sum on Thursday. The money DID NOT pass through CSEA nor were they informed of the lump sum payment PRIOR to disbursement. So, as I may not know the politics of your Plant...I do know what information has had a direct impact on my family. Please educate me, though...I'm very interested in how the process works. I have three wonderful children in which that money belongs to.
  12. Is there anyone else that would like to tell me that Fred got Kristine Shremp pregnant? Obviously, this is common knowledge in the plant. If you are just one of his supporters that want to intimidate me or threaten me, please save it. He has told me enough about each of you that would make you reconsider your alliance with him. FYI: Fred portrays himself as a family man. He campaigns as a family man. My house in in default and me and my children will probably lose it, he stopped paying my car payment months ago so my car will be repossessed (pays double on his + his new Harley), the cable has been disconnected, the gas company is coming today to disconnect our gas, he drained the bank accounts over 2 months ago and left my children & myself with no money---zero, and I've received the electric & water disconnection notice. That's the family man Fred Pena is. Domestic violence? Go read the police reports. No need to whisper behind our backs, they are public record. Is he really a family man? Ask Kristine and all the others he has left a trail of. Is he deceitful? We all know the answer to that. Bribery? Drugs? He's not that hard to catch. He brags, he gossips, he boasts. I give him credit, he did hide the fat woman fetish very well.
